Family reunification in Spain

Family reunification in Spain gives you the possibility of providing your financially dependent loved ones with residence in Spain. The most common cases are the regrouping of minors as well as couples. In all cases, the nationality of the sponsor and his economic capacity play an important role. Family reunification requirements vary depending on these conditions. The main thing, therefore, is to distinguish between community family reunification for those linked to Spanish or EU citizens and the case of non-EU citizens or legally resident foreign citizens. This last case is the most frequent. It must be taken into account that this permission, in any case, supposes the dependence of the regrouped person on the regrouper. This is not only of an economic nature, but also the duration of the card is linked to that of the sponsor. This does not prevent it from being possible to change to another type of card or residency such as the third-party account or the self-employed or, depending on the case, the nationality.

Resident foreign family reunion

The family reunification of resident foreigners is the way for first-degree relatives to obtain their first residence in Spain. In other words, it is designed for children or parents as well as the spouse or partner in a similar relationship of verifiable and demonstrable affectivity of a foreign citizen residing in Spain. The right to regroup ends at the age of 18, but the residence procedure can be carried out due to parental dependency. In the same way, the ascendants must be over 65 years of age, demonstrating their economic dependence. In the event that the family member is not in any of these age ranges, there must be a cause that justifies it, such as a serious disability that prevents him from fending for himself. Depending on the nationality of the regrouped, it will be necessary to start the procedures with the consulate or with the Consulate of Spain of their residence or with the immigration office of the reunifier. Rommunity family reunion

Community family reunification is the simplest procedure for ascendants, descendants or family partners of Spanish or EU citizens to obtain residence. Its procedure is very similar to the family reunification procedure for foreigners residing in Spain. However, it presents a series of peculiarities that give it advantages over the previous case. One of its advantages over any other temporary residence of the general regime, in addition to the procedure, is that it is granted for a period of five years. As a general rule, the maximum age of the regrouped in this case can be up to 21 years. As in the previous case, There are exceptional circumstances that make it possible for the family member to exceed that age, due to the incapacitation or economic incapacity of the family member. In addition, another of the extraordinary assumptions, which does not exist in the general case, is that of community family reunification by extended family. This applies when even though there is no first-degree link, in fact there is a situation that is comparable. That is, for example, the case of orphaned minors whose parents are cared for by grandparents, uncles…

The request for community family reunification will normally be processed at the Spanish consulate where your family resides, although there are exceptions depending on nationality.
